I have three aims in this essay. I want to offer an example of an interdisciplinary historical inquiry combining literary criticism with the relatively new field of critical legal studies. I intend to use this historical inquiry to argue that the ambiguity of literary texts might better be understood in terms of an era’s social contradictions rather than in terms of the inherent qualities of literary language or rhetoric and, conversely, that a text’s ambiguity can help us expose the contradictions (...) masked by an era’s dominant ideology. I try to prove my assertion by applying my method to Herman Melville’s three most famous short works—“Benito Cereno,” “Bartleby, the Scrivener,” and Bill Budd, Sailor—works dealing with the law and lawyers and widely acknowledged as ambiguous.1 I will base my critical inquiry into these stories on Melville’s relationship with his father-in-law, Lemuel Shaw, who, while sitting as the chief justice of the Supreme Judicial Court of Massachusetts from 1830 to 1860, wrote some of the most important opinions in what Roscoe Pound has called “the formative era of American law.”2Before I get started, I should clarify what this study does not entail. By using Shaw and his legal decisions in conjunction with Melville’s fiction, I am not conducting a positivistic influence study. My method will not depend on the positivist assumption that Shaw’s legal opinions can be used to illuminate Melville’s texts only when his direct knowledge of Shaw’s opinions can be proved. Nor will I limit myself to a traditional psychoanalytic reading: my emphasis is on political and social issues, and too often these issues are deflected by translating them into psychological ones. At the same time, I recognize that critics concerned with political and social issues too often neglect questions raised by a writer’s individual situation. I compare Shaw to Melville not to reduce Melville’s politics to psychology but to prevent a political study from neglecting the political implications of psychology, to remind us—as the title of Fredric Jameson’s book The Political Unconscious reminds us—that psychological questions always have political implications. 1. It has often been argued that Foucault’s turn to antique and early Christian care of the self, spiritual self-.practices and truth-telling (parrhesia) results from inquiries into the confession practices and pastoral power structures in the context of a genealogy of the desiring subject. This line of reasoning is in itself not incorrect, but – this article claims – needs to be complemented with an account of Foucault’s philosophical quest for freedom and for conditions, possibilities and modes of thinking and acting (...) differently vis-à-vis the normalizing regimes of power in science and, hence, in philosophy as an academic discipline. In this context a first turn to antique philosophy seen as a ‘way of life’ constructed through ascetic practices can be detected already writings from the late 1960s and early 1970s. Although indeed the project of the history of sexuality moved in a direction than Foucault had foreseen in the first volume published in 1976, earlier reflections on the need for free and critical philosophical thought relative to scientific ‘disciplines’ already prelude the later inquiries into care of the self, self-practices and parrhesia as productive for a critical philosophical attitude. Nietzsche's strengths as a critic are widely acknowledged, but his peculiar style of critique is usually ignored as rhetoric, or dismissed as violent or simply incoherent. In this book, Nietzsche's concept of the agon or Wettkampf, a measured and productive form of conflict inspired by ancient Greek culture, is advanced as the dynamic and organising principle of his philosophical practice, enabling us to make sense of his critical confrontations and the much disputed concept of transvaluation or Umwertung. But the sort of context sensitivity exhibited in such sentences does not compromise the claim that meaning determines truth conditions, since recourse to context here is directed and restricted by conventional meaning alone. Anyone who understands sentence (2) knows that its utterances are true just in case whatever object is demonstrated in the context of utterance is nice; and he also knows that any utterance of (2) says of, or expresses about, whichever object is demonstrated that it’s nice. According to Wolterstorff, an accurate genealogy of rights begins, not with the late Middle Ages and the Enlightenment, but with the Hebrew and Christian Scriptures. The Gospel of Luke, Wolterstorff says, provides especially important witness, and he gives it considerable attention. Wolterstorff's careful analysis of Luke is both lexical and narratological. This paper argues that the lexical data of the Gospel of Luke does indeed lend some support to Wolterstorff's case. But the support is qualified since, in Luke, a critical (...) word group—the dikaio -family—is used in a way that emphasizes relationship to God rather than obligations to neighbor. The most important narratives and teachings of the Gospel lend similarly qualified support to Wolterstorff's genealogy. The paper concludes that while nothing in the Gospel of Luke is incompatible with the observation and defense of human rights, the program Luke sketches has another focus that a comprehensive reading of that Gospel must keep in view. According to the presentist the present time is the only one that there is. Nevertheless, things persist. Most presentists think that things persist by enduring. Employing E. J. Lowe’s notion of identity-dependence, Jonathan Tallant argues that presentism is incompatible with any notion of persistence, even endurance. This consequence of Lowe’s ideas, if soundly drawn, is important. The presentist who chooses to deny persistence outright is a desperate figure. However, though Lowe’s notion is a legitimate and worthwhile one, this application is (...) faulty. The incompatibility of presentism and persistence is not part of Lowe’s heritage. A positive conclusion can be drawn. A form of persistence is compatible with presentism. It is one on which persistence is defined in tensed terms using an adverbial tense operator: x persists iff x exists and existed or will exist. Unsurprisingly, so understood persistence is endurance. I entitled the paper ‘An Essay in Speculative Mysticism’ because it undertakes, in the tradition of such ancient and mediaeval mystics as Plotinus, Pseudo-Dionysius, Hugh and Richard of St Victor, Nicholas of Cusa, Ruysbroeck, and Meister Eckhart, to mate psychological introspection with ontological speculation, focusing on the rather fundamental themes of Identity, Alterity, Transcendant Identity , and Illusion . I acknowledge my more recent, general indebtment to the rich reservoir of contemporary research in the area of Transpersonal Psychology, a research (...) amply documented in the journal of Transpersonal Psychology , as well as in the bibliographies, most notably provided among others, in the respective works of Charles Tart, John White, and Ken Wilber. Since Transpersonal Psychology embraces within its attempts at controlled studies such sundries as altered states of consciousness, parapsychological phenomena, yoga, as well as doctrines which skirt the very frontiers of psychology's experimental ingenuity, namely the tenets of G. I. Gurdjieff, P. D. Ouspensky, H. P. Blavatsky, Oscar Icazo, John Lilly, Roberto Assagioli, and many others, the rapport between a speculative study in mysticism and the background data supplied by Transpersonal Psychology becomes readily apparent. Furthermore, I accede to any reader's deft detection in my essay of a rather uncommon medley of remnants from Thomism, German Romanticism, British Neo-Hegelianism, Vitalism, and Structuralism. If, at last, I were to be questioned on the methodology of my paper, I would have to respond that it probably resembles most closely the methodology of two French Reflective thinkers, viz., Jean Nabert and Henry Duméry, and the French existential metaphysician, Jean Wahl. Since I owe so much to so many, I simply acknowledge my general indebtedness at the beginning and allow the essay to emerge with its own internal cogency. The paper's rationale should, therefore, emanate from a clear inner coherence of its ideas as these reflect communicable psychological experience and unfold some of the latter's ontological implications.
